Thank you for visiting SpeedySpots.com (the “Site”) operated by Speedy Spots, Inc. This website is provided to you subject to the following conditions and by using our services you are agreeing to these terms. Please read the Terms of Service (“Terms”) carefully as it involves your legal rights and obligations and provides information regarding your privacy. If a conflict exists between the Terms and the content of this site, these Terms of Service will control. We reserve the right to make changes to our site and these Terms at any time and without further notice to you. You are deemed to accept and agree to be bound by any changes to these Terms when you use our services after those changes have been made.

SITE AND ACCOUNT ACCESS

Speedy Spots grants you a limited license to access the Site for your personal use. The Site or any portion of it may not be reproduced, duplicated, copied, sold or resold, or otherwise exploited for any commercial purpose without express written consent of Speedy Spots. Any unauthorized use of this Site terminates the license granted by Speedy Spots. Unless otherwise noted, all content included on the Site, such as text, graphics, and images is the property of Speedy Spots and is protected by the State of Michigan, United States and international laws. Speedy Spots' copyrights, trademarks and trade dress may not be used without its express written consent.

Individuals under the age of 18 are not allowed to register with the Site without the supervision of a parent or legal guardian. Children under the age of 13 are strictly prohibited from registering or using the Site. Furthermore, we do not knowingly collect, solicit personal information, or allow account registration from children under the age of 13.

Speedy Spots reserves the right to refuse and cancel service, terminate accounts, or remove or edit content at its sole discretion and for any reason.

INFORMATION COLLECTION AND USE

Your personal and financial information will not be shared with any third parties except as outlined in these Terms. Information is collected from our customers to provide services, process orders, and to better serve you. Information collected includes your name, billing address, telephone numbers, e-mail address, and debit and credit card information. The Site may employ third party companies to perform services on our behalf including hosting, marketing assistance, e-mail delivery, and debit and credit card processing. WE DO NOT SELL OR RENT YOUR PRIVATE INFORMATION TO THIRD PARTIES. WE DO NOT SPAM OUR CUSTOMERS.

Information provided by you to the Site is yours and you may request that we delete your account at any time. Upon a request to delete your account, we will permanently delete any stored credit card information from our servers related to your user account.

COOKIES AND LOG FILES

PURCHASE OF SERVICES AND REFUNDS

When paying for services, you will need to provide your debit or credit card information. The Site accepts only Visa, Master Card, Discover and American Express, and the merchant listed on your debit or credit card statement will be Speedy Spots, Inc. To process your debit or credit card information, your personal and financial information will be shared with the merchant bank for authorization and approval. When paying by debit or credit card you authorize Speedy Spots and its agents to charge your debit or credit card for the amount specified at the time you submit payment. We will charge your debit or credit card at the time your payment has been submitted, after which you will receive a confirmation e-mail of your payment. If for some reason there is a problem processing your payment, we will use the contact information you provided to us in order to reach you. The Site reserves the right to delay service until payment has cleared. All payments are in U.S. dollars.

Under no circumstances may you charge back fees to Speedy Spots. If your debit or credit card issuer or network does not honor a payment, then we have the right to charge the amount of any such transaction to your account or to collect the amount from you. If you attempt to charge back fees or the charge is declined or reversed by the debit or credit card issuer or network, your account will be immediately discontinued, service will be discontinued, and you will be responsible for costs and reasonable attorneys’ fees associated with reclaiming the amount of the chargeback.

Due to the nature of our services, the Site will not provide refunds. ALL SALES ARE FINAL and no refund, credit, or exchange for any reason except if we make an error which will be corrected at no expense to you.

COMMUNICATIONS

When you visit the Site or send e-mails to us, you consent to receive communications from us electronically either by e-mail or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

TO THE FULL EXTENT PERMISSIBLE BY LAW, SPEEDY SPOTS DISCLAIMS AND MAKES NO REPRESENTATIONS AS TO ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SPEEDY SPOTS DOES NOT WARRANT THAT THIS SITE; INFORMATION, CONTENT, AND SERVICES MADE AVAILABLE TO YOU THROUGH THIS SITE; ITS SERVERS; OR EMAIL SENT FROM SPEEDY SPOTS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. APPLICABLE LAW AND MISCELLANEOUS TERMS

You agree that any legal dispute will be adjudicated in any state or federal court in Washtenaw County, Michigan, and you consent to exclusive jurisdiction and venue in such courts. You also agree to a non-jury trial.

You shall defend, indemnify and hold harmless Speedy Spots and its officers, directors, shareholders, and employees, from and against all claims and expenses, including but not limited to attorney fees, in whole or in part arising out of or attributable to any breach of these Terms by you.

These Terms represents the entire understanding and agreement between you and Speedy Spots regarding the subject matter of the same, and supersedes all other previous agreements.

We reserve the right, and you authorize Speedy Spots, to disclose your personally identifiable information as required by law, when necessary to protect our rights, to prevent prohibited or illegal activities, or comply with a legal proceeding, subpoena or court order.

The provisions of the Terms are intended to be severable. If for any reason any provision of the Terms shall be held invalid or unenforceable in whole or in part, such provision shall be ineffective to the extent of such invalidity or unenforceability. The failure of Speedy Spots to exercise or enforce any right or provision of the Terms shall not operate as a waiver of such right or provision.
